The law in this area can be tricky, and making a UM/UIM claim without the benefit of an experienced attorney could have devastating consequences.

Insurance Bad Faith & Breach of Contract
People carry insurance to protect themselves from devastating events such as fires, auto accidents, or disabling injuries. The purpose of having the insurance is to ensure that a bad situation doesn't turn worse. When these events happen, and (1) the insurer denies instead of pays the claim, (2) offers to pay only a portion of the claim, or (3) delays payment for months or even years, hoping that the claimant will grow weary of the process and accept less than what is owed, the original devastating event is exponentially exacerbated, oftentimes leaving claimants in dire straits. Pedestrian Accidents
Pedestrian accidents occur for many reasons; cars, motorcycles, buses and bicycles can all hit people on the street, in the crosswalk, even on sidewalks. Many times motorists just don't see pedestrians or are distracted, or they fail to yield the right of way in a pedestrian crosswalk or at an intersection. Whatever the reason, the rule is simple - pedestrians should never be struck by motorists, period. Negligent drivers may not be the only cause of a pedestrian accident. Crosswalk location and road design can also contribute to, and/or be the direct cause of a pedestrian accident. Identifying and pursuing all proper defendants is reason enough why you should consult a personal injury attorney prior to making your claim for injuries and damages with just the motorist.

Premises Liability
If you are injured because of a hazard on someone else’s property, premises liability states that the responsible party is the owner of the property. However, finding out who the owner of a property can be difficult. If you fall on a patch of ice on your neighbor’s steps, then your neighbor can be held responsible. The same can be said if you visit a store and are injured — the responsible party is either the store or the owner of the building or in some cases, both entities. And if you are injured on government property, then you may have a case against the government. But it’s not easy to prove responsibility in these types of cases. The other party can come back and say that the fault is yours since you weren’t “paying attention to your surroundings” (i.e., the condition that caused you to be injured was "open and obvious" or the defect was "trivial." You should retain a lawyer experienced in this area of the law who can effectively help you through the claim process - and make sure that you don't fall victim a second time.
